My name is Billy Rogers. I am sharing my firsthand account of the origin and creation of the FIREHOUSE SUBS franchise concept, along with supporting materials, including my Expert Polygraph Test Results, which I have made available for public and media review.


BACKGROUND


I am a former professional Florida firefighter. I graduated from the Florida State Fire College in Ocala, Florida, and served with the Rockledge Fire Department ("A" Shift) in Brevard County.

I was also involved at the inception of the FIREHOUSE SUBS venture in 1993 as:

  • A third co-founder and venture participant 
  • The original creative author 
  • The initial store décor designer 
  • A contributor to the brand’s early concept and identity 


During that time, I created foundational materials and concepts that, to my knowledge and belief, continue to be reflected throughout the FIREHOUSE SUBS franchise system today.


THE CORE ISSUE


I allege that I was never properly compensated for my original creative contributions and intellectual property associated with the early development of the FIREHOUSE SUBS brand.


Over time, my role and contributions were not publicly acknowledged, and I believe that the value derived from those contributions has not been fairly recognized or compensated.


This matter has been the subject of long-standing dispute.


THE 1993 BUSINESS BOOKLET


In 1993, I authored and created what I refer to as the  1993 Firehouse Subs Business Booklet


This booklet contained:

  • Textual concepts and brand narrative 
  • Early design direction 
  • Foundational “design elements” 

These design elements include:

  • Line 
  • Color 
  • Shape 
  • Space 
  • Texture 
  • Typography 
  • Overall visual attributes 


The booklet was created on a home computer and physically produced shortly after initial discussions among three firefighters regarding the venture.


Throughout the document, the use of the term “we” reflects the collaborative nature of those early discussions.


DESIGN ELEMENTS & BRAND CONTINUITY


It is my position that the look, feel, and “firehouse” atmosphere of FIREHOUSE SUBS franchise locations today reflect, in substantial part, the concepts and design direction expressed in the 1993 booklet.

  • Current FIREHOUSE SUBS franchise environments

The long-term vision expressed in that booklet included brand franchising, with consistent design elements across all locations.


PUBLIC NARRATIVE VS. MY ACCOUNT


Public statements over the years have described the founding of FIREHOUSE SUBS as attributable solely to Chris and Robin Sorensen.


My position is that this narrative omits material facts regarding the early formation stage of the venture.


Specifically, I assert that:

  • The original concept involved three firefighters 
  • My contributions were integral to early brand franchise development 
  • My role has not been accurately represented in public accounts 
  • I have not been compensated for my key intellectual properties created and contributed to our venture in 1993

RELATED EVENTS AND CONTEXT


This situation, in my view, reflects broader issues involving intellectual property recognition and compensation.


By way of comparison, similar disputes have arisen in other contexts involving inventorship and ownership of creative contributions.


Additionally, prior legal disputes involving FIREHOUSE SUBS and third parties relating to trademark rights further underscore concerns regarding intellectual property practices.


FINANCIAL CONTEXT


FIREHOUSE SUBS has grown into a significant brand franchise system.

Franchise disclosure documents (FDDs), including the 2015 FDD (see page 77), reflect substantial royalty revenue derived from franchise operations.


These royalties are associated with the use of the brand frachise system, including the “total concept and feel” and the “firehouse” themed environment.


It is my position that elements of that system trace back to my original contributions.


PERSONAL IMPACT


This matter has had a significant personal and financial impact on me and my family.

For many years, I have sought acknowledgment and fair treatment regarding my contributions to the formation of the FIREHOUSE SUBS brand.

FIREHOUSE SUBS CO-FOUNDERS CONT:

 

 In early spring 2012, after years of being strung along and remaining patient as advised, I, Billy Rogers, had no choice but to formally submit a written demand (via email and USPS) for proper compensation for my original intellectual property contributions—literary images and design elements—to the Firehouse Subs business venture in 1993.  These design elements remain embedded throughout the Firehouse Subs franchise brand as of 2020.    "Design Elements" Comparison Exhibit Here.  


Thereafter, the Co-founders, Chris and Robin Sorensen of Firehouse Subs had their Jacksonville based Intellectual Property Attorney, Richard Vermut contacted me / Billy Rogers by phone on 03/19/2012.     Here linked is the phone message for review from "FIREHOUSE SUBS" IP Attorney, Richard Vermut.


After my writings and phone conversations with "FIREHOUSE SUBS" Intellectual Property Attorney, Richard Vermut I was subsequently contacted by email and postal service with a formal letter from  the Co-founders, Chris and Robin Sorensen lawyer.


The Sorensen brothers, by and through their Intellectual Property Attorney,  answered by written reply letter to me on July 27th 2012.    The Co-Founders, Chris and Robin Sorensen vehemently DENIED any and all of my / Billy Rogers claims that I / Billy Rogers had a key creative involvement in the "Genesis" of the "FIREHOUSE SUBS" Franchise System .   Please review the brothers, Chris and Robin  Sorensen, July 27th 2012 written reply letter to me / Billy Rogers )

This July 27th 2012 letter from Co-Founders, Chris & Robin Sorensen by and through their Attorney ----was untruthful.


Thereafter,  My wife (Dawn Rogers) and I  sought to have an Expert Polygraph Test administered by the late, great Jack Trimarco---a Former FBI Special Agent / Profiler who is/was deemed to be the best Polygraph Expert / Examiner on the planet. 


I wanted to take an Expert Polygraph Test to prove, once and for all, I did create and contribute "Intellectual Property"  in the "genesis" of  the "FIREHOUSE SUBS" System.

 

I sought to undergo an expert polygraph examination to substantiate my co-founding of the “Firehouse Subs” franchise brand alongside the Sorensen brothers, as mutually agreed in 1993. Accordingly, readers will note that the term “we” is consistently used throughout the text of the “1993 Firehouse Subs Business Booklet.” 


I  subjected myself to an Expert Polygraph Test by renowned, Former FBI Examiner; Jack Trimarco on November 6th 2016.     I under went an expert Polygraph Test was performed on November 6th 2012 in Beverly Hills, California, at Jack Trimarco's Office on Wilshire Boulevard.

For those who feel that Polygraph Tests are not effective / accurate---please know that it is fact that the FBI gives a Polygraph to all rankin and file Federal Agents every six months for checks and balance regarding high security.   In other words, Polygraph Tests are accurate enough for National Security and protection of  U.S. Government Classified Information.


Furthermore, there is scientific data, that only 20% of people tell the truth---Jack Trimarco shared this very sad and disturbing fact--when I passed my Polygraph Testing. After saying to me, "welcome to the 20% club, Billy!". 


My Polygraph Test was passed well above and beyond normal ranges that are +1, +2, +3...
